Sea Eagle Sailing Charters - Terms and Conditions

General

Provided: crew, accommodation, use of kayaks, snorkels, goggles & flippers, access to wireless internet connections (subject to network coverage), equipment on board including DVDs and games, Spray jackets if required.

Not included: wet suit (recommended but not essential for snorkelling), scuba gear, transport to and from the boat, evening meal and accommodation on Saturday 31st October in Eden (please contact us if you would like us to help organise this).

**Parents of children under the age of 12 will be required to provide life jackets for their children to ensure correct fit.

Bookings and cancellations.

Bookings must be made directly with SeaEagle Sailing Charters.

A non-refundable deposit equal to 50% of the cruise price is required by 1 August with full payment by 15 September.

Cancellation policy: No refunds will be given to cancellations received after 15 September, unless a replacement booking is received before departure in which case the booking will be subject to a $200 cancellation fee per person.

Insurance

We strongly recommend the purchase of travel insurance.

Medical

The nature of a sailing holiday or charter requires passengers to have a minimum level of fitness.  Passengers with mobility problems are advised to contact the operators prior to booking to discuss the required abilities.

As parts of the sailing holiday or charter take place in areas with limited or no nearby medical facility, we require passengers over the age of 70 and those with ongoing medical conditions such as heart disease, diabetes, epilepsy to supply a medical certificate from their GP stating that they are fit to undertake the cruise.

SeaEagle Sailing Charter crew are all qualified in first aid and can be in contact with shore based medical advice, but paramedical help may be some time in arriving.

Passengers taking medication should ensure they carry sufficient medication for the trip.

We strongly recommend the purchase of travel insurance. 
 
Weather

SeaEagle 5 is built to withstand all weather sailing, however for the comfort and safety of other passengers and the crew, an alternative itinery may need to be followed to the itinery originally planned if the weather/sea is particularly inclement.  In this event, we will consult with the passengers, but the Master’s decision to sail or not sail to a particular destination or anchorage will be final. 

Unless the trip is cancelled altogether prior to departure due to extreme weather, SeaEagle Sailing Holidays/Charters will not be required to refund any portion of the fees paid due to changed itinery.

Loss, damage and injury.

SeaEagle Sailing Charters and SeaEagle Sailing Holidays will not accept any liability for loss or damage to personal possessions or professional equipment brought aboard SeaEagle 5, nor for any personal injury or loss of life whilst engaged on a cruise or charter.

Liability

By booking with us, you agree that SeaEagle Sailing Charters and SeaEagle Sailing Holidays will not accept liability for the consequence of delay, damage or changed itinery may have on onward travel, medical conditions or any other factor.

Children

Children under the age of 18 must not be booked on trips unless accompanied by an adult who is known to them.  Children are welcome on trips where family and friends are travelling together as a group with no other passengers.

Marine and Safety Tasmania require us to carry a suitable life jacket for each passenger.  Due to the different shapes sizes and ages of children, parents may be requested to bring a suitable life jacket for each child under the age of 12, to ensure a correct fit.

The nature of a sailing holiday is such that it may not be suitable for children under the age of 7.  Parents must understand that they are responsible for the safety and conduct of their children at all times. The crew are not responsible for the supervision and entertainment of children on board or ashore beyond reasonable duty of care. 

Wilful Damage

Passengers who wilfully cause damage to the vessel or its equipment, to the possessions of other passengers or crew, or cause wilful damage to shore based infrastructure or the environment may be prosecuted and the cost of replacement or repair recovered.

Illegal activity

The operators of SeaEagle Sailing Charters reserve the right to put ashore at the nearest town any passengers found to be involved in illegal activity.  No refund will be given for any part of the cruise or charter not utilised due to passengers undertaking illegal activity.

Alcohol

Crew aboard SeaEagle Sailing Holidays/Charters practice responsible service of alcohol and request passengers to respect this practice for the comfort and safety of all aboard the vessel. For the safety of the vessel and other passengers, alcohol may not be consumed in adverse weather conditions or extended offshore cruising except at the discretion of the Master.
